1. Acceptance of Terms

By accessing or using the GSE Repair service application (the "Platform"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to all of these Terms, you must not access or use the Platform. These Terms apply to all users of the Platform, including but not limited to customers, mechanics, administrators, and any other authorized personnel.

2. No Warranty — Service Provided "AS IS"

THE PLATFORM AND ALL SERVICES PROVIDED THROUGH IT ARE OFFERED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. The operator, its affiliates, officers, directors, employees, and agents (collectively, "Operator") make no representations or warranties of any kind, express or implied, regarding the operation, availability, accuracy, reliability, or completeness of the Platform or any information, content, or materials provided therein.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE IN TRADE.

3. Limitation of Liability — COMPLETE WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES arising out of or relating in any way to:

• Your use of, or inability to use, the Platform;
• Any repair, maintenance, inspection, or service request submitted through the Platform;
• Any damage to equipment, vehicles, or property—including but not limited to ground support equipment (GSE)—that occurs before, during, or after any repair or service;
• Any delays in response, repair completion, or service fulfillment;
• Any inaccuracies, errors, or omissions in information submitted by users;
• Any unauthorized access to or alteration of your data or transmissions;
• Any loss of data, business interruption, or lost profits;
• Any personal injury or property damage arising from equipment use or repair;
• Any third-party claims arising from equipment operation, maintenance, or repair.

4. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Platform;
• Any repair request, work order, or service instruction submitted by you;
• Your breach of these Terms;
• Your violation of any applicable law, regulation, or third-party right;
• Any damage, injury, or loss caused by equipment operated, maintained, or repaired under a service request submitted through the Platform.

This indemnification obligation survives termination of your access to the Platform.

5. User Responsibilities

By using the Platform, you represent, warrant, and agree that:

• Accuracy: All information you provide—including equipment details, issue descriptions, location, and contact information—is accurate, complete, and current. You are solely responsible for any errors or omissions.
• Authorization: You are authorized to submit service requests for the equipment identified and have the legal authority to bind the entity on whose behalf the request is made.
• Compliance: You will comply with all applicable laws, regulations, airport rules, and safety protocols when using equipment and when interacting with maintenance personnel.
• Confidentiality: You are responsible for maintaining the confidentiality of your login credentials. The Operator is not liable for any unauthorized use of your account.
• Prohibited Conduct: You may not misuse the Platform, including by uploading malicious code, attempting to gain unauthorized access, or interfering with the operation of the Platform.

6. Service Disclaimers

6.1 No Guarantee of Response or Completion

The Operator does not guarantee that any repair request will be received, reviewed, prioritized, or completed within any specific timeframe. Response times are estimates only and are not binding. The Operator reserves the right to prioritize requests at its sole discretion based on operational needs, available resources, and safety considerations.

6.2 No Guarantee of Repair Quality

All repairs are performed by third-party mechanics or service personnel. The Operator makes no warranty, express or implied, regarding the quality, workmanship, or fitness of any repair. Users acknowledge that repairs are undertaken at their own risk.

6.3 Equipment Condition

The Operator is not responsible for the condition, maintenance, or safety of any equipment submitted for repair. Users are responsible for ensuring their equipment is safe to handle, inspect, and repair at the time of service.

7. Third-Party Services and Content

The Platform may integrate with or link to third-party services, including but not limited to messaging services (e.g., Telegram), cloud infrastructure providers, and database services. The Operator is not responsible for the availability, reliability, security, or performance of any third-party service. Any interactions with third-party services are solely between you and the third party.

8. Data and Privacy

By using the Platform, you consent to the collection, use, and storage of information you provide, including equipment data, contact information, and communication records, for the purpose of facilitating repair requests and operational communication. The Operator will implement reasonable security measures to protect your data but makes no guarantee against unauthorized access, data breaches, or data loss.

The Operator may share information with mechanics, service providers, and relevant personnel as necessary to fulfill repair requests. The Operator will not sell your personal data to third parties.

9. Intellectual Property

All content, design, code, and materials comprising the Platform are the exclusive property of the Operator or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform solely for its intended purpose of submitting and tracking equipment repair requests.

10. Modification and Termination

The Operator reserves the right, at its sole discretion, to modify, suspend, or discontinue the Platform (or any part thereof) at any time without notice. The Operator may also revise these Terms at any time by posting updated terms on this page. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

The Operator reserves the right to terminate or restrict your access to the Platform for any reason or no reason, including violation of these Terms, without liability.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be severed and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms constitute the entire agreement between you and the Operator regarding your use of the Platform and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, Florida.
